What you’ll do:

Responsible for managing a heavy litigation docket, client communications, investigations, pre-litigation matters and all aspects of trial. Provide legal support and advice to stakeholders relating to subrogation and third party liability matters. 

What you can expect:

  • Handle all aspects of pre-trial and trial litigation, including motions work, depositions and discovery, ensuring appropriate recoveries are received
  • Provide advice and counsel to internal and external stakeholders; address and resolve legal issues and disputes; interpret laws, regulations and determine application to subrogation claims
  • Authorize in-house subrogation settlements; approve wavier of subrogation rights in workers’ compensation settlements; negotiate and settle complex subrogation cases ensuring appropriate recovery
  • Work closely with claims representatives, investigators, experts, and outside attorneys relating to subrogation matters;, provide legal assistance with records, subpoena and testimony requests; provide litigation updates and information relating to subrogation claims handling to ensure high level of customer service to stakeholders; timely respond to inquiries, complaints and concerns
  • Oversee outside counsel, address issues relating to litigation strategy, budget, and settlement evaluation/authority; coordinate litigation and legal matters with outside counsel and reduce legal costs
  • Develop and provide training programs to internal and external stakeholders on: evaluating civil issues for liability, causation and damages, subrogation issues and impact on policies, considering comparative negligence and other factors
  • Provide strategies and techniques on negotiating and settling subrogation reimbursement and utilizing proper standards of investigation
  • Implement operating standards and keep current on best practices and regulations; develop and update templates and policies
  • Track current cases and legislation that affect subrogation recoveries; conduct legal research to understand new legal issues and evolving legal requirements; drive legal strategy of subrogation development
  • Expedite settlement in the best interest of internal and external stakeholders
  • Supervise paralegals, control day to day legal operations and work closely with subrogation claims representatives, assist in file analysis and settlement negotiations, provide close oversight of paralegals and subrogation representatives over their handling, negotiation and settlement of subrogation cases to ensure adequate recoveries and that deadlines are met
  • Ensure day-to-day activities are consistent with discipline strategies and standard processes
  • Assist management in implementing team operational strategies to achieve financial and business objectives (profit, growth, retention and customer experience strategies)
  • Provide mentoring, daily desk-level quality assurance, coaching and on-the-job training to ensure discipline consistency and performance oversight
  • Serve on Company committees to offer legal advice
  • Perform special projects as assigned
  • Perform other duties as assigned

What you need to be successful:

JD degree from an accredited school of law.  Licensed to practice in Colorado.  Continuation of education is encouraged and supported. Strongly prefer five or more years’ experience in Colorado personal injury and insurance litigation, including products liability, construction law and other areas of bodily injury law. Strong written and oral communication skills, and strong problem-solving skills. Comfortable working in a multi-tasking, high pressure environment. Knowledge of the Colorado Workers’ Compensation Act required.  Experience in leading and managing others a plus.

The compensation amount for this role is targeted at $145,300-$155,600. Final offer amounts are determined by multiple factors including your experience and expertise and may vary from the amounts listed above.
